Originally they did allow just that and old manuals explicitly said so.
But too many idiots abused the possibility just to test used phones,
they had to stop it. The real problem is that at least in Germany, not
any SIM will do, it has to be a valid one. Most vendors of prepaid cards
demand a minimum of action and break the card if not used for typically
three months. Many old people have bought a phone just for emergencies,
charged up the prepaid card once, and then never used it. (They do keep
the battery charged.) Should an emergency occur all their phones will be
duds. Those predpaid vendors willingly accept the death of helpless
people just to increase their profits.
