Making the loser pay the > winner's legal fees would _fix_ that problem. Ok, so, lets say you are poor, or just "ok" as far as money goes. You've been wronged by a multi-millionaire, so you decide to sue. You have your $150/hour lawyer working for you. The multi-millionaire has 20 (or 30) $750/hour lawyers working for him. You are fairly certain you'll win, but, you have only one lawyer, and his 20 or 30 are racking up one hell of a bill that you'll have to pay if, by chance, you end up losing. Winning depends upon your one lawyer being able to talk 10 plain folk into believing that you were wronged enough to find the multi-millionaire guilty. Losing simply depends upon one of the multi-millionaire's $750/hour lawyers finding some argument, or one of them being sweet-talking just enough, to convince just enough of the jury that the multi-millionaire did not in fact legally wrong you (and "just enough" could be one of the 10, who convinces the others to go along with him/her). And, if you lose, you will be bankrupt, because 20+ $750/hour lawyers working 80 hour weeks for months on end up till the trial rack up a bill that is several times your total and future net worth. So, do you still decide to sue, or do you decide the downside risk, even if you determine you have only a 5% chance of loosing, so horribly outweighs the upside gain, that you simply don't bother suing?

Or you've _not_ been wronged by anyone, but you decide to sue the nearest multi-millionaire anyway in hopes of a big payday. > Winning depends upon your one lawyer being able to talk 10 plain > folk into believing that you were wronged enough to find the > multi-millionaire guilty. No, "winning" depends on your lawyer generating enough paperwork that it's cheaper for the defendant to pay you to go away than to fight you. For instance, today, if you sue him for $1M, and it will cost him $500k to beat you in court, he'll offer to settle for $250k--regardless of whether he wronged you at all. OTOH, under my proposal, he will only offer to settle if he thinks he's going to lose in court. > And, if you lose, you will be bankrupt, because 20+ $750/hour > lawyers working 80 hour weeks for months on end up till the trial > rack up a bill that is several times your total and future net > worth. OTOH, if said multi-millionaire decides to sue _you_ today, you're bankrupted by the cost of _winning_ in court. > So, do you still decide to sue, or do you decide the downside risk, > even if you determine you have only a 5% chance of loosing, so > horribly outweighs the upside gain, that you simply don't bother > suing? One can see a need for bond agents that will judge your case's merits and set the amount you need to pay based on the odds of you winning. So, if you have a 5% chance of losing, you would only need to put up 5% of the cost. Good lawsuits would still succeed, but bad lawsuits would be unaffordable. The jury oft assesses > damages against anyone near they think has deep pockets. That's largely due to contributory negligence, another US invention. For instance, you break your leg while burglarizing a house. You sue the homeowners for $1M in pain and suffering. As the person who is 90% responsible for the injury, you accept your guilt (and must pay yourself $900k), but that makes your victim liable for the 10% of the damages that they "contributed", and they have to pay you $100k--more than you got from robbing them in the first place, and this time it's completely legal!
