You could define the list type as something like this (Haskell syntax,
ML looks a little different but works about the same way):
-- this defines the cons datatype, with accessor functions
-- car and cdr to get at its fields
data Cons a b = Cons { car :: a, cdr :: b }
-- this is a discriminated union of Nil or a field containing a cons.
data List a = Nil | Nonempty (Cons a (List a))
A cons node here is a pointer can only be made with the Cons
constructor, so it can never be null. E.g. the car and cdr functions
know (statically, because of type checking) that their arg is a cons, so
they don't have to check it against null at runtime. In this
representation (unlike Lisp), a cons is its own datatype and is not a
list all by itself.
If you're traversing a list, you do have to check with a case statment
that each node is a cons, before you can access the cons to progress to
the next node. E.g. you could write something like:
mapcar f Nil = Nil
mapcar f (Nonempty (Cons x xs)) = Cons (f x) (mapcar f xs)
which is syntax sugar for a case statement on the second arg to mapcar.
(This is an inefficient implementation for ML since it's not tail
recursive and can cause a big stack buildup, but it's ok for Haskell due
to lazy evaluation).
The above is just illustrative and I think ML and Haskell don't actually
have naked conses in their normal list type. List is defined more like:
data List a = Nil | Cons a (List a)
