Well, the distinction is legal rather than practical. In either case, 
if you're dead you're dead.

Absent the International Criminal Court (to whose authority the US 
refuses to submit), who is there that can judge? Or does one just say 
"we can't know, so it doesn't matter"?

Of course you (and I) don't know. And they won't tell us, either. But 
how would you hold such a trial (and under whose authority)? Who is in 
the dock? The President? The individual (CIA?) employees responsible 
for the targeting and killing? The obstacles are imposing. If a 
corporation is a "person", is the govt, and can it plead the 5th?

With a civil suit, if the defendant doesn't answer, the plaintiff wins 
by default. In the absence of evidence provided by the govt, what 
other choice is there?

The inhabitants of My Lai (women, children, and old men) were 
"unlawful combatants" only in the same sense that the inhabitants of 
the village of Lidice were.

As for the Abu Gharib prisoners, some of them probably were. Under the 
Geneva Convention, such must be treated as POWs until a "competent 
tribunal" finds them to be unlawful combatants". Were they examined by 
a "competent tribunal" and found to be such? Even so, they must still 
be "treated humanely". Would you call their treatment "humane"?

As to whether it is a "war crime", My Lai certainly was. Abu Gharib 
was probably a violation of the Geneva Accords, and probably a crime, 
but I'm not sure what the precise definition of "war crime" is.

The USA even has a high security court. The United States Foreign 
Intelligence Surveillance Court (FISC) issues the National Security 
Agency (NSA) with court orders authorising the tapping of phones and 
bugging of buildings. Extending that court's powers would not be too 
difficult.

True, but all indications are that the FISC is a govt lapdog. From 
1979 through 2013 the govt submitted 35,529 applications for warrants, 
and the FISC approved 35,517. One of the court judges publicly 
complained that applications were sometimes backed by false 
information, but apparently the court can live with that,

Whatever Mary Baker Eddy might have had to do with the design of nuclear 
weapons, or anti-personnel weapons, escapes me at the moment.

Not that encouraging parents not to get medical treatment for their sick 
children is not wrong, but usually that's not the sort of thing people call 
"crimes against humanity".

Or, possibly, this has nothing to do with the Church of Jesus Christ, Scientist 
and instead has to do with the kind of science that sticks to technology, and 
doesn't try to needlessly trouble the faithful by speculating on evolution or 
cosmology.

It's just part of my .sig, and is not intended to apply directly to
the topic in the thread.  But since you mention it, the OSS
psychological workup on Hitler suggests that MBE was much like Adolf
(1942).  Fast-forward to the late Nineteen Seventies, and we have
Stansfield M Turner as Director CIA subsequent to being NATO CIC,
Allied Forces Southern Europe.  He would have been cleared to know
all about strategic and tactical nuclear weapons during that time.

Now a comparison of nominal equivalence between Hitler and MBE is not
in and of itself a reflection on the religious movement, unless the
OSS knows more about the Church of Christ, Scientist than they have so
far disclosed through declassified publications through their
successor the CIA.  Nevertheless it is concerning considering the
church's eschatology as we know it.  I have personally had a brush
with a seemingly high-profile member or members of that "faith" and
can assure you that on that basis the slur is applicable.

It might be if they (some of them) know they are dooming their
children to sickness or death deliberately while they hide behind the
excuse of religious doctrine.  But that is not the main thrust of my
aspersions on their religion.  I do not propose to go into great detail
here other than to note that many religious people behave one way when
they know someone is watching, and quite another when they feel they
are unobserved.

While I don't like street cameras, they have indeed helped identify
bad cops who have shot people for no valid reason.  They have also
served to justify some police shootings.

Of course, now society is debating whether certain circumstances justify

I understand your point, but 'special prosecutors' have their own

Our society is focused a great deal on cops and their bad behavior.
However, we need to also focus on prosecutors and their bad behavior.
Prosecutors have a great deal of power and resources, that really
isn't balanced out by the defense.

Previously posted was an article about some accused terrorists sent
away for life who maintain their innocence.  The govt's star witness
was a convicted criminal, who apparently went to a great deal of trouble
encouraging the defendants to plan an attack.  We now know the prosecutor 
in the case, now a politician, is a real opportunist (IMHO, a liar.)

I don't think we used to allow dual citizenship, and I don't think we
should.  You're either American or you aren't, and if you aren't, you

you're drafted by another country that _also_ claims you as a citizen,
the US won't revoke your US citizenship in response, but it won't do
anything to protect you from that happening either.

Also like most countries, the US _creates_ millions of dual citizens by
refusing to recognize a renunciation of US citizenship made as part of
the oath of citizenship to another country.  So, if you move to Canada
and become a Canadian citizen, you don't lose your old US citizenship
unless you either voluntarily serve in the Canadian military, renounce
your citizenship at a US consulate/embassy (you can't do it in the US
because you'd instantly become an illegal immigrant), or a handful of
other rare circumstances.

Joining or serving in another country's military in and of itself does 
not affect US citizenship, unless there was intent to renounce US 
citizenship (hard to prove). Serving as a commissioned or 
noncommissioned officer in the military of another state that is 
engaged in hostilities with the US will do it, though that would imply 
that merely serving as a soldier isn't enough.

That's the key point that the anti-government types fail to understand.
Government exists because the vast majority of people agreed to create it,
recognizing that having a government is in their best interest.

Every society has rules; govt is merely an institution created to
enforce those rules.

Your problem is not with govt; you simply don't agree with (some of)
society's rules, in particular the one saying that, as a member of a
society, you have to pay your share of society's costs.

There are two remaining cases of terra nullius; you are welcome to move
to either one, but don't expect to live very long.  There is a _reason_
societies institute govts.

Who and which state, specifically?

The very definition of terra nullius is that _no_ state asserts
authority over it, and in both cases, the potential claimaints take
pains _not_ to do so when they very easily could.

A society inherently has authority over its own members, and if it
chooses to institute a govt, it imbues it with that authority.
