Science is mainly an endavour of single individuals, who only occasionally work for some agencies (or communities, corporations or similar). That is actually very important, because science requires creativity, while large organistions require conformity. For which physical agency Einstein could have been a spy, I don't know. As he was a Swiss citicen, he could have worked for the Swiss equivalent to the KGB (or MI6 or whatever), even if the Swiss pretends not to have no such agencies. (But possibly the Swiss agencies operate from other countries...) TH
