"Auslegung" ist allerdings kein Freibrief für Mißachtung.
Die "gesamtgesellschaftliche Verantwortung" obliegt zuerst dem
Verordnungsgeber. Wenn dieser seine Verodnung nur mangelhaft begründet
und dann, auf Nachfrage durch das Gericht, nur herumstottert, dann hat
der Richter gar keine andere Wahl.

Ja und dann ist es Aufgabe des Verordnungsgebers, diese Punkte anzuführen.
Es ist nicht die Aufgabe eines Gerichtes, für zweifelhafte Verordnungen
eine passende Begründung zu drechseln.

Ja und den Parteien obliegt es, ihre Argumente vorzutragen. Wenn der
Beklagtenvertreter das nicht tut, dann hat er offenbar gar keine Argumente.
