I can't imagine why you think that experimental protocol is remotely 
convincing. You clearly affect the position of the pendulum when you're 
preparing to release the rod. It should have been easy enough to arrange 
a mechanical release so that such interference wasn't possible. But 
then, of course, the experiment wouldn't have worked.
