Since that critera, the way you apply it, is wrong, it doesn't matter. There is ONE and only ONE true criteria. And by that your machine fails. It is possible to show that some other criteria give EXACTLY the same answer, and are thus valid alternate criteria, but that still means that the actual criteria is also valid. YOUR criteria, the way you interpret it is DIFFERENT, and thus NOT VALID. You try to sneak it in by the fact that with a different interpretation of the words, it actually is a valid criteria. Basically, youy are trying to cheat with it.
