It's really not a helpful question. Before you can answer such a 
question, you need to define the word "alive". Once you've done that, 
you can answer the question, which accordingly serves no real purpose.

You can't start at the end and work backwards.

The issue of fair use only arises if the use would otherwise be a breach 
of copyright. Not all uses are a breach of copyright, so your starting 
point has to be the question of whether the particular use is a breach.

If a copyright specifically states that the work may only be copied,
without prior permission, for use within a commentary on the subject
or a critque of the original work, and the copier does nothing but
copy the original work absent any commentary or critque, it seems
pretty clear to me that the copyright has been violated.

Generally speaking your view has NOT been taken by the courts who have 
supported authors with the lone exception of satire. Of course Wormley's 
cut and paste may actually fall under that exception!

It seems odd. If an author publishes a small portion of someone else's 
work and uses that in an attempt to debunk it he's often accused of 
"cherry-picking", but if he publishes it all he's accused of copyright 
infringement. Seems like a no-win situation.

This is why it's good to include a reference to the entirety of the the 
original work, so the reader can decide for themselves whether you've 
cherry-picked. If you have, then it's obvious by comparing your extract 
with the full original reference.
