No error is involved.  No matter how much convoluted 'logic' you may
attempt the fact is that the best position in the absence of
supporting evidence is that of non-existence.

The lack of evidence does not prove non-existence, but the claim of

When there is a binary situation requiring a certain response using a
lack of evidence as a basis for that response makes perfect sense.
