CLERMONT COUNTY, Ohio (WKRC) - The toxicology reports have been added to the crash report for an October crash that left five people dead. Ohio State Highway Patrol said that 25-year-old Matthew Penny is the driver responsible for the deadly crash at the intersection of State Route 28 and Edenton Pleasant Plain Road. According to a toxicology report, Penny had 106 nanograms of marijuana per milliliter in his system. That's more than 50 times the legal limit of 2 nanograms. The second driver in the crash was 43-year-old Dustin McDole. The toxicology report showed McDole to have a blood alcohol level of .267. That's more than three times the legal limit of .08. Investigators said the crash occurred when Penny, driving a Chrysler 300 northeast on State Route 28, entered the oncoming lane to pass another vehicle. He crashed into McDole, who was attempting to cross the road in a Subaru Legacy from Edenton Pleasant Plain Road. The impact resulted in a catastrophic rollover crash. Three other individuals were killed in the collision. Andrea Iery, 42, was a passenger in McDole's vehicle, while 19-year-old Chloe Love and 18-year- old Dezmen Jernigan were passengers in Penny's car.
