A Toledo man who had been released from jail five days earlier was arrested Saturday on a burglary charge after a woman told police he broke into her home and raped her.

Officers responding to the location in the 500 block of Eastern Avenue found Rodrick Neal, 32, of the 900 block of North Michigan Street, lying naked on the alleged victim’s bed, according to an affidavit filed in Toledo Municipal Court.

Neal was booked into the Lucas County jail, and Municipal Court Judge Amy Berling set bond at $500,000 during his arraignment Monday before scheduling a preliminary hearing for May 30.

According to the affidavit, a neighbor called 911 about the incident, and the alleged victim told arriving officers that Neal had raped her. Police said Neal gained access to the home after breaking a window.

Neal had been sentenced Feb. 28 to 90 days in the Corrections Center of Northwest Ohio for his previous case, in which police said he was administered naloxone for a drug overdose Feb. 17 but then bit a police officer at the scene and later kicked that officer and another, both in the chest, in an emergency room at Mercy Health St. Vincent Medical Center.

He was initially charged with felonies for drug abuse and assault on a police officer, but those counts were reduced to misdemeanors to settle the case. CCNO records show he spent 76 days there, from Feb. 28 until May 15.

Neal in 2017 had entered an Alford plea to third-degree domestic violence, for which he was found guilty and sentenced to 24 months in prison and three years’ post-release control. He had initially been charged in that case with two domestic-violence counts plus third-degree grand theft.
