You have no right that I can see to do that. Did you clear this with Mike Westerfield? I don't believe he would be supportive of his work being distributed in this way. Please take it down.

Hi All, I understand the frustration of waiting and one not getting sth paid must be refund. Nevertheless, making a torrent of an item that is downloadable (after payment) is stupid. Syndicomm, apart from h/w, should make all items cheap and downloadable, this is the only way to go. Now that we can afford things (that item is 3 months of an internet or a mobile telephony subscription), just pay them, if not to try to wake up Syndicomm, at least to thank Byteworks for their great software. Thank you, Antoine ps. Tony, you should communicate.

Someday I will buy Opus ][... in the meantime I have already thanked Mike for Orca C. He must be a really smart guy to write the way he writes. One paragraph by Mike Westerfield is worth a whole chapter by Microsoft, and that is a fact! >ps. Tony, you should communicate. At least you weighed-in on this. But we can't expect Tony to actually admit that he is just lazy. He will just pretend that everything is ok. Bill

Everything is not ok. https://www.facebook.com/groups/5251478676/permalink/10153820797518677/ I lost my mother to Alzheimers in March at age 90 after decades of deterioration. The last 6 years were the worst. I am surrounded with family and friends who are living with or dying from chronic illnesses, including Alzheimers In 1998 I was given 5 years to live; after an entire lifetime of chronic illness starting in 1969 when I became infected with the Hepatitis C virus. Between 1999 and 2000 I did a round of very severe therapy that killed the virus. Today at 62 I manage the diabetes that I contracted as a result of this treatment, and the devastating arthritis that I have lived with since my 30's that requires 2 hours in the morning to become mobile enough to walk. In 2004 I went fishing commercially, a young man's game that demands a high level of strength and stamina. I continued to develop software while I fished during leaves of absenses from my consulting until 2009 but the rigours of a 3 hour commute and my wish to remain alive resulted in a decision to fish year round and abandon the corporate culture and feed people. I could write many books on the raising of a family and how I developed my career against all odds, and what I have done locally and nationally in advocating for health issues, etc. Today I have taken my weight down to 190 pounds from the 260 pounds that I was in 2004. I push myself hard and limit my physical stress to no more than a 12-16 hour workday. Before I ran support groups, and took my treatment, I went to the gym 2 hours a day, biked to work through Canadian Winters and just generally tried stay physically and mentally even. I made huge messes in my life and achieved modest accomplishments. Everyone has a story, and has a life. This does not change the fact that syndicomm is trouble and will need to be fixed or removed. This is business. Bill

I should probably not bother weighing in on this, but: - I like Tony personally and believe he is an important member of the Apple II community. - I do not believe he fails to fulfill orders in a timely fashion out of conscious intent to cheat anyone. - But I also don't think it's acceptable for him not to fulfill paid orders in a timely fashion, and even though his intentions are good and his circumstances may not be, there's no justification for his not filling orders which others have given him money for, because if the customer paid, and that customer doesn't receive his or her product within a reasonable timeframe, that customer has been harmed. - It's entirely reasonable to be angry at Tony and critical of him if he accepts money and does not ship what has been purchased in a reasonable timeframe. - But that doesn't make one morally justified in bypassing an author's wishes about how his software is distributed. You can do it, but it just makes you a pirate. That's fine, I'm hardly piracy-pure, but don't think that somehow Tony's actions or lack thereof justify your piracy; there's no quid pro quo there. If you actually gave Tony money and he won't refund it or deliver what you purchased, you're fucked, and you can go ahead and publicly declare what has happened to deter others from doing business with him. However, it doesn't morally entitle you, or anyone else, to distribute the software yourself. - Saying "they wouldn't have bought it anyway so piracy a victimless crime" is the kind of rationalization for piracy I used when I was 11; it's weak sauce. Taking and using something you're supposed to pay for, even if you didn't deprive anyone else of it because it's copyable digital media, is still unfair to those who actually paid for it. - Distributing an author's software yourself against his wishes just because it's old is also not something you have any moral justification for. It too just makes you a pirate. You're not entitled to something just because you want it or think it's old enough that it should be free. - Characterizing people who attend KansasFest as somehow being Tony's collaborators is, frankly, inane; using this fantasy as an excuse to not attend KansasFest is even more inane. Telling others who actually make the effort to go to KansasFest that they're supposed to take up an issue with Tony that doesn't involve them personally when you can't be bothered to go yourself is the most inane of all. - TL;dr: Grow the fuck up. Tony may be an incompetent business operator and you may feel he doesn't take adequate responsibility to serving his customers, and you might even be right, but don't impugn anyone else in the Apple II community from your fucking keyboard, and don't pirate software with any pretense other than that's exactly what you're doing.

When I started the torrent, I was under the (apparently incorrect) assumption that whatever it was was some lost archive or no longer available stash. I still have strong opinions about the state of development tools on the GS, but that's another rant for another time. I have withdrawn my seeding; there haven't been too many uploads compared to even the weaker torrents I'm used to running myself. (For the record, I do consider myself a pirate, being a fansubber; I do not mean harm to anyone unless I feel they've crossed a line, but I had to do some thinking about the situation before I made the call. I was under a mistaken impression, but continued the seed while I thought it over to give the uploader the benefit of the doubt.) -uso.

> I still have strong opinions about the state of development tools on the > GS, but that's another rant for another time. I think this is exactly the place for this rant, actually. The sequestered nature of these packages is an outright blight on the hobby. The license holders and vendors of this material need to have a good long think about what's best for the community. Apple // (especially //gs) needs new blood if it's going to survive and right now that means poor, bored, 20-somethings. Keeping this stuff locked up is generating a pittance per annum while stifling potential growth. Maybe to retirees and 50-something engineers who have been with the hobby for decades $35 doesn't sound like much for a C compiler but it's a damn Great Wall of China for young people looking to try something new.

A) Write a note to Tony saying hey, we want to give you the benefit of the doubt, but shit's fucked up if you take money and don't deliver. If that fails, b) post here and on the Facebook group saying "hey, heads up, my (or person I know) Syndicomm order hasn't been filled, I'm not happy, caveat emptor." c) ask someone you know who has a copy of the thing that you paid for so you can get the thing that you paid for [I don't have a problem with this as long as it isn't mass-distributed] d) go to KansasFest for the cameraderie and if you happen to see Tony, ask him wtf. e) email author of the software as has been previously proposed and ask "It's 2015, PayPal exists, can you please sell your stuff directly and bypass the guy who doesn't actually deliver your product?" What do you think?

Since I don't like to sit on my hands, and I like Paypal because it's simple like I am, and easily links to Canadian and American banks and credit cards, and its fees are reasonable, that part sounds good. The idea of everything at syndicomm seemed kind of neat and tidy to me at one time. After hearing some other ideas I realize my thinking may be in a rut about this. I'm tired of thinking about this for now. I want to go do some C code... I am having great fun with ImageMagick and my Apple II graphics converters, and I think I'll just get lost in there for a day or two and see what happens. Bill

The best thing morally, IMHO,is avoid Syndicomm, and write the original authors and ask to freeware whatever product. Syndicomm is obviously a mismanaged mess. I found that trying to get people who can't manage their own responsibilities into your life will just make your own life a little more unmanageable. You could also simply pirate the software and leave the responsibility for the original authors to contact YOU. Works for Jason Scott and archive.org probably the biggest pirates of old software on the internet right now! --- news://freenews.netfront.net/ - complaints: news@netfront.net ---

Of all the posts here, no one really has put the responsibility on the buyer. Paying by Paypal has its protection against this sort of thing as well. For ANY purchases, follow these easy steps. 1) Pay using Paypal 2) if non-delivery within 50 days, open a grievance, no matter what. This opens an avenue of communication and forces the seller to communicate. 3) post emails only through Paypal and not privately so Paypal can track the attempts at communication. 4) request in the email to the seller to give you an approximate day of deliver 5) make at least 3 attempts at communication with seller. 6) if seller does not reply then request Paypal for a full refund after 60 days. If a reply has been made with an approximate delivery date, wait 3 days after delivery date and if non-delivery (item could have got lost in the mail), try contacting seller again using Paypal email system 7) request refund any time after 60 days Since eBay and Paypal have separated, I don't think there is no longer the ability to leave feedback, but at the very least, this hurts the sellers standing with Paypal, and if Paypal drops the sellers account, then there is no longer an option to purchase from the seller using Paypal. For me, I wouldn't purchase anything online without using Paypal. It is an excellent set up for online purchases and offers all the protection a person needs if used correctly.

It is simply not practical to purchase from other countries if it can be avoided. The inflated US exchange has driven-up costs of goods outside the US that are good for exports from here, providing US components are not used. The other consideration for Canadians buying from Canadians is that the RCMP will investigate an online rip-off if you phone the detachment nearest the seller. With this hobby, buying from other countries is unavoidable. Really good things like the CFFA3000 are fortunately shipped without problem. But cost more than I would like to pay. Bill
