Most service providers charge for their "native" tethering; sometimes they don't for limited plans. With many phones you can run a 3rd party tethering app, but Samsung phones block this. According to Sprint, the Verizon court case involved the conditions for a specific bit of spectrum auction, and doesn't apply generally.
