You are WRONG Snit.
You have been told that you are wrong several times.
Having been told that you are wrong, and repeating your assertion means 
that 
you are lying.

1.  Asus was and is a member of the Open Hanset Alliance.

2.  The Open Handset Alliance was established on 6 November 2007, led by 
Google with 34 members including mobile handset makers, application 
developers, some mobile carriers and chip makers.

3.  Members of OHA are not allowed to (i.e have agreed not to) produce 
devices that run incompatible versions of Android.

5.  In consequence, Asus had a choice:-

  a)  Remain a member, and not produce devices that run 
      incompatible versions of Android, or (XOR)...
  b)  No longer be a member of the OHA.

There's no "prevented" about it.  For example, Amazon is not "prevented" 
from using Android as the basis of its own OS - but cannot be a member of 
the OHA.
