As RD has pointed out, the case with Jack is more involved. (Though there are "structural similarities" between these two "problems".)

But it's indeed a fact that D(D) either halts or doesn't halt. And the behavour if D(D) is DETERMINED by the code of D.

It's a rather simple fact: No program can (correctly) dermine for all programs P and input data d if P(d) stops or not. 

Why do you have such problems with this simple theorem/fact?
