The "problem" for your alleged "halt decider" H is just that it (1) states that D(D) halts if D(D) doesn't halt and (2) states that D(D) doesn't halt if D(D) halts. (Here I'm assuming that H(P, d) terminates for all syntactically correct programms P and any data d as input data.)

So H **IS NOT** a "correct" halt decider BY DEFINITION (of the notion of a /halt decider/).
