No, that exists currently too.  If I create a work today, it's protected
under my State's laws automatically, but only within my state.  That's
entirely independent of Federal law and the Berne Convention.  State's
Rights is the basis of that, i.e., a State has the legal right to control
everything within it's borders that's not explicitly granted to the Federal
government.

"Copyright under the Berne Convention must be automatic; it is prohibited to
require formal registration (note however that when the United States joined
the Convention in 1988, it continued to make statutory damages and
attorney's fees only available for registered works)."  -Wikipedia

I.e., without formal registration in the US, you have (basically) zero legal
rights.  You can't claim infringement.  You can't collect damages.  Etc.
