I think such caveats were fairly common.  When Winnipeg built its new city 
hall in the 1960's they used land that was given or sold to city for the 
explicit purpose of being a farmers' market.  That use was fading then, but 
there were legal battles.  There have been similar situations in Edmonton 
where I live now.
