There is no incompatibility in distributing CDDL. You mean just like it is hard for the US to convince Iran to stop its nuclear program. Now you might decide not to copy it anyway, since that would be your right, but if you met the other conditions of the license ( assuming they were legally fine) the writer would not be able to enforce this section of the copyright on you. As I understand it, that is Schilling's attitude towards the parts of the GPL that are claimed to be in conflict with the CDDA. And he has at least some legal opinion on his side. This does not mean that GPL is invalid in its entirety. Just that some of its claims are invalid.
