Here is the legislation from the UK Government: https://www.legislation.gov.uk/ukpga/1998/31/section/71 The authors of the papers do not explain what they mean by "compulsory" but, instead of having the wit to checking it out, you jumped to an interpretation that matches your own obsessive prejudices - a good example of confirmation bias.
