Emission theory provides no sensible reason why EM radiation should leave the source at a speed of c. On the other hand, the modern understanding of special relativity is that c is the proportionality constant that relates space and time. Photons happen to travel at c because they are massless. There is no speeding up or slowing down of photons to match c. The measured speed of a beam of light is the same for all observers because that is just how the geometry of spacetime works out. Different observers don't "do anything" to the beam of light to make the beam have the same speed. It is just that if one follows a sensible measurement protocol, one will always come up with the same value for the speed of light. It's sort of like, no matter how you draw a triangle in a plane, whether it be acute, obtuse, or whatever, the sum of the angles is always going to add up to a straight angle. That's just the way the geometry works out. One can't argue with a geometric theorem. Likewise, one can't argue with c being a maximum speed in Minkowski spacetime. At low speeds, Minkowski spacetime is extremely difficult to distinguish from Euclidean 3-space and time. By analogy, over small distance scales, the surface of the Earth is difficult to distinguish from a plane. At high speeds, marked deviations of Minkowski spacetime from Euclidean 3-space and time become apparent. By analogy, over large distance scales, the surface of the Earth is obviously different from a plane.
