Hey, Thalidomide was/is a legal prescription drug. But if the company making it
deliberately used the threat of libel suits to prevent pregnant women from
being aware that there was a risk of it harming their children, criminal
investigations - using whatever laws there are to facilitate such
investigations - of those responsible aren't a "witch-hunt".

Evidence has been found, and is in the public record, that tobacco companies
made efforts to confuse and mislead the public about the link between tobacco
and lung cancer. Since this was in pursuit of commercial gain, it's not the
same as a personal expression of political opinion: they weren't offering ideas
to be considered, they were offering lies to ensnare others.

Not in the US it wasn't.

Since RICO exists only in the US and Thalidomide was not legally for
sale in the US, RICO has nothing to do with Thalidomide. Sorry. You
picked a bad example.

So why is RICO necessary? False advertising is illegal without RICO.

So? An injustice "withstanding the test of time" doesn't make it any
less an injustice. You argument applies equally well to such
institutions as slavery.

Well, they've withstood the test of the appeals courts anyway.

RICO is a criminal statute. If you're under RICO investigation, you're
being considered for prosecution. Saying they're not asking for anyone
to be prosecuted, just investigated under RICO, is idiotic.

No, it can't. Not without repealing the 1st Amendment.

You can't make an even halfway reasonable comment without ruining it
with some invective, can you?

Of course, they're not going to launch an expesive investigation without
suspecting that those being investigated are guilty. I'm pretty sure
that if the investigation is unable to find adequate evidence of
wrongdoing, the whole effort will stop.

As the petition says, what the Senator is proposing and what the
scientists are supporting is similar to the way RICO was used against
the tobacco companies when they put out tons of misinformation about the
harmfulness of cigarettes after the harm had been established medically.
Short form: RICO has been used this way before.

The RICO prosecutions of the tobacco companies were based overwhelmingly
on their actions, not their speech, specifically the manipulation of the
nicotine delivery of cigarettes, deceptive marketing of regulated
products (cigarettes) as "light" or "low tar", and failing to produce
safer cigarettes, as they had promised to.

Conversely, this new "throw the deniers in jail" movement by the
Warmists is based *solely* on their speech and nothing else. The
so-called "deniers" aren't marketing regulated products; they aren't
failing to live up to a negotiated promise with the government to
produce a product of a certain quality; and they haven't falsely
manipulated any product in commerce.

So the comparison to the RICO case against the tobacco companies fails
on multiple levels. This is a proposed prosecution based on nothing but
pure speech and disagreement with "the consensus".

What's next? Throwing people in jail because they disagree with "the
consensus" on Obamacare, because that deprives people of their civil
right to health care? Or putting pro-2nd Amendment/gun rights supporters
behind bars because the "progressive" intelligentsia has determined that
it deprives people of their civil right to be free from violence? Or
criminalizing any pro-life speech because it deprives people of their
civil rights to an abortion?

Why is it the Left, when given the power, always wants to jail or
execute anyone who dissents or disagrees with them?

Statism: Ideas so wonderful, they have to be mandatory!

Same old lie.

Who has been jailed? Who has been executed?

Except it's not.

In this case, no one yet. The Warmists have certainly expressed the
desire for jailings, however. Which is what I said: "...always wants
to..."

In the broader sense, millions have been jailed and executed by leftists
on the loose. Mao, Stalin, Guevara, Castro... the list is voluminous.

Well, he's the pinnacle of murderers, and, yet you left him off your
list of leftist killers.

Did you just forget the worst of the worst? Or didn't you want to
admit that the biggest slaughterer wasn't a leftist, but a right wing
psychopath?

It kind of knocks your premise into a cocked hat...where it belongs.

Not hardly. Stalin and Mao both beat him by a significant number.

No, 'cause he's not.

With respect to the Soviets this, it seems, may have been exaggerated by
Cold War propaganda. Hard to tell at this distance but Hitler probably beat
out Stalin by a good couple of millions (see
http://www.nybooks.com/articles/archives/2011/mar/10/hitler-vs-stalin-who-killed-more/
for one viewpoint). Which by no means makes Uncle Joe a jolly good fellow,
but worse than Hitler? Not really.

Mao's regime, on the other hand, was indeed the most murderous in history.
Possibly five times more than Hitler - the Great Leap Forward alone may
have had a death toll approaching 50 millions.

He was, however, most likely worse than everyone other than Mao.
