It's already marked as 'upstream' and 'fixed-upstream', so the tags are fine.

Upstream commit 4370b673ccf240bf7587b0cb8e6726a5ccaf1f17 titled
"MIPS: scall: Save thread_info.syscall unconditionally on entry"

That commit is part of 6.9-rc4 and autoselected for 6.8, 6.1 and 5.10
on 2024-04-22 by Sasha Levin, but I haven't seen them in their
respective Stable queues yet?
