My client isn't picking up the torrent from the magnet link... otherwise I
would have tried to put two seedboxes on it :/

You have to wait a while, Transmission usually takes a while to find peers.

:P

Well, both my servers (running, as you said, Transmission) did eventually
pick it up and are now seeding.

I usually don't use magnet links, but most of the torrents I make are
anime-related and I just post them to an anime tracker. =p

People in the community who take people's money without delivering
software do far more to destroy the community than people who, as a
result, make that software available in some other way.

I remember reading the same stuff on this very newsgroup back in the
early 90's when the commercial Apple II software publishing industry
was in its death throes. The result of that discussion was that ftp.asimov
was created, and all the copyright maximalists vanished from the scene.
I don't see this discussion ending any differently.

If the software is actually available for purchase, and people who pay
for the product actually receive the product in a timely manner, then
people of good will are going to choose to purchase the product. If
the product is not available, or is not delivered, it will be put up for
grabs on an ftp site or a torrent, for the betterment of all. End of story.

You have assumed that non-delivery and non-delivery in a timely-enough manner for someone (you?) are the same thing.

Tony is delivering. Seemingly delayed, but he is still delivering.

That time has not come yet.

If Syndicomm takes my money, the product had better be in the mail within
a week. There's no excuse for any greater delay, other than perhaps Tony
is in the hospital.

If he can't fulfill orders, he ought to pass on the business to someone else.

It has already come --- obviously, as the link was posted here.

I am not advocating that people put up the products Syndicomm is selling on
FTP sites or torrents. I am just saying that if Syndicomm doesn't produce,
someone will make the products available in another way.

Hi Sheldon,

Isn't it interesting what can happen when an ecommerce site isn't living up
to people's expectations?

I assume that syndicomm is being run on a best effort basis.

Downloadable - Price $80.00 USD

http://store.16sector.com/index.php?main_page=product_info&cPath=1&products_id=203

1. The syndicomm website is still accepting money.
2. Mike Westerfield is still actively developing Software. He replied to one
of my posts on the FaceBook group a couple of months or so back about Orca
C.
3. Tony Diaz is also on the FaceBook group and confirmed recently that he is
still selling Opus ][.

Not only is it possible to pay for it and download it; it is probably
expected by Mike and Tony both.

As far as this torrent of Opus ][ goes; is it even possible to remove the
torrent now that it has been seeded by the OP? Removing the link from csa2
is not practically possible as far as I know either.

But then I could be wrong; perhaps it is possible to remove the usenet posts
from every server in the world that carries the feed and/or stop the
propagations of the torrent.

Fair Dealing in Canada for personal use only provides for private copying in
the absence of a substantial adverse effect on the exploitation of the
original work; the rights holder (Mike Westerfield or APDA, etc) has the
exclusive right of reproduction, the right to rent the software, the right
to restrain others from renting the software and the right to assign or
license the copyright to others. Exceptions to these rights are set out by
the terms of Fair Dealing, these exempt users from copyright liability
covering usage and reproduction when performed for research, private study,
education, parody or satire.

"Fair Use"

http://en.wikipedia.org/wiki/Fair_use

In the US, Fair use is a defense to an allegation of copyright infringement
under section 107 of the Copyright Act of 1976. To justify the use as fair,
one must demonstrate how it either advances knowledge or the progress of the
arts through the addition of something new.
Fair Use measures the effect that the allegedly infringing use has had on
the copyright owner's ability to exploit his or her original work. The court
not only investigates whether the defendant's specific use of the work has
significantly harmed the copyright owner's market, but also whether such
uses in general, if widespread, would harm the potential market of the
original. The burden of proof here rests on the copyright owner, who must
demonstrate the impact of the infringement on commercial use of the work

Courts consider whether the use in question acts as a direct market
substitute for the original work.

I could be wrong but I don't think Marco intended to buy Opus ][. Neither do
I think did Uso intend to buy it. I think these guys are just having fun.

Do you seriously think that Mike will lose potential sales because of this?

I already own a copy of Orca C. I can't afford the time to play with
Opus ][ right now. I've been thinking about it buying it for years. I am
still thinking about it.

It would cost Mike money to take this to court... and to what extent if any
does the burden of responsibility to select a reputable delivery mechanism
for his product rest on Mike? I am not a US lawyer so I don't know what a US
lawyer would say about this... but if I were judging this, I would call a
lawsuit on this frivolous and not worth the aggravation; something like
Jaywalking or Spitting on the Sidewalk.

Don't get me wrong; I think Orca C is well done, and the Manual is
exceptional. But is there really damage here? Or just some guys bickering
about their hobby?

Maybe Tony's apparent lack of urgency is appropriate too... it's not like an
airplane fell out of the sky when he doesn't ship an order. Maybe this is
Tony's way of having fun. I doubt that though.

Let me go back in time at about 30 years from now.

Here in north Italy you can find Nibble (and other) magazine in a few selected international news-stand. You can read all the magnificent software advertisement, then you can go to your nearest Apple reseller and found that they never, NEVER, NERVER heard of them.

So forgive me, if you can, but I waited 30 years, that's enough!

Marco

I would have no problem spending $80 for Opus ][ if I had any use for it.
I bought ORCA/M back in the day, and I'd gladly do it again if I need it
for some reason.

But I have a big problem with people who take $80 and fail to deliver.
If I were to pay $80 up front for Opus ][, I would expect shipping within a
week.

Given that Syndicomm apparently can't be bothered with delivering
paid-for product, it looks like Mike Westerfield would be better off just
putting his work up for free download along with a PayPal button for
donations.

Tony has not done that.

You can download it straight away.
