Agreed. But then almost any copy is a derivative work.

Hard to do. That was why Phoenix went through the whole "Chinese wall "
game with the IBM bios back in the original PC days. They had one team
abstract the functionality of the bios, and the second code that
functionality without ever seeing the original code. But it would have
been pretty hard for Microsoft to argue that they had done that. Having
one of the chief architects on board makes "independent creation" a hard
sell.
