I don't know what the legal situation is on your side of the Pond, but I would have thought that it was a purely commercial decision by your network provider. In the UK, for example, '3' don't allow what they call 'tethering' (using the phone as a hotspot) on certain tariffs - although it tends to work in practice even though forbidden!
