A simple "no" would have done.

Seriously, you are merely pretending that if you say A and then I
explain why I think A is incorrect, and offer evidence, that repeating A
will somehow show support for your view.

?!?

That's exactly what you're doing. Scout offered a stinging rebuttal to your claims, and all you can
do is pretend you've already covered it and restate your claims.

You're a fraud.

My claims are simple... and so far unrefuted.

* The meaning / usage of "bear arms" (pretty much
exclusively for "war, soldiering or organized, armed
   action".

* Their were laws restricting firearms at the start of
the country which were never, as far as I can find,
challenged on second amendment grounds. This makes it
a hard sale to say they were against the second
   amendment.

* Most (though not all) relevant scholars have supported
   the states rights view.

* We should not allow the NRA, a group that benefits from
mass shootings and terrorism, to largely control our gun
   laws.

* We clearly do have, have had, and should have, limits on
arms... what one could call "infringements".

* We should do more research on gun deaths and injuries, as
we do with vehicles, pools, food, and pretty much everything
else that is tied to death and injuries.

* I back evidence-based policies.

Meanwhile I am called a "gun grabber" and other nonsense is tossed
around. Whatever.

I have found that the O.P. is unreliable in quoting. A few years ago,
he edited one of my postings making significant semantic changes and
then replied to the edited version. The least he could do is to write
his own stuff.

The NRA's quotes are all taken completely out of context. For
example, here is an article I wrote on Federalist #46 (fed-46). Now,
fed-46 just isn't that long of a document and they really shouldn't
take one sentence out of the middle.

**** Previously published material

One reads the Federalist today to gain an insight into the motivations
of the men most instrumental in drafting the Constitution and the Bill
of Rights. In the Federalist, the authors are arguing in favor of the
ratification of the Constitution of 1787; the essays were written
between the writing of the constitution and the first ten amendments
primarily as the collaborative effort of James Madison and Alexander
Hamilton. Federalist 46 is important in that its author is discussing
the militia explicitly as defined in article six of the United States
Document of Confederation. Federalist 35 had recently been published
wherein Mr. Hamilton used the exact words: "well regulated militia".
(When the Federalist was bound and published as a book, #35 was
renumbered as #29.)

Dominating the debate was the locus of power. Would this be with the
states or the federal government? Did the federal government have the
power to levy taxes? And, not least, would the armed forces be
controlled by the states or by the federal government? The latter is
the topic of the second amendment. No place in the discussion is the
individual right to self defense even mentioned; no place is it ever
suggested that "the people" have some right to rise up and overthrow
the constitutional government... as if one would need constitutional
authority to take up arms against the constitution! The idea of
"bearing arms" was never mentioned in any context except the militia.

For your reading pleasure, here is the full text of Federalist No. 46
with some paragraph breaks added.

Federalist No. 46 (James Madison writing; published 1/ 29/1788)

The only refuge left for those who prophesy the downfall
of the State governments is the visionary supposition that the federal
government may previously accumulate a military force for the projects
of ambition. The reasonings contained in these papers must have been
employed to little purpose indeed, if it could be necessary now to
disprove the reality of this danger. That the people and the States
should, for a sufficient period of time, elect an uninterrupted
succession of men ready to betray both; that the traitors should,
throughout this period, uniformly and systematically pursue some fixed
plan for the extension of the military establishment; that the
governments and the people of the States should silently and patiently
behold the gathering storm, and continue to supply the materials,
until it should be prepared to burst on their own heads, must appear
to every one more like the incoherent dreams of a delirious jealousy,
or the misjudged exaggerations of a counterfeit zeal, than like the
sober apprehensions of genuine patriotism.

Extravagant as the supposition is, let it however be
made. Let a regular army, fully equal to the resources of the
country, be formed; and let it be entirely at the devotion of the
federal government; still it would not be going too far to say, that
the State governments, with the people on their side, would be able to
repel the danger. The highest number to which, according to the best
computation, a standing army can be carried in any country, does not
exceed one hundredth part of the whole number of souls; or one
twenty-fifth part of the number able to bear arms. This proportion
would not yield, in the United States, an army of more than
twenty-five or thirty thousand men.

To these would be opposed a militia amounting to near
half a million of citizens with arms in their hands, officered by men
chosen from among themselves, fighting for their common liberties, and
united and conducted by governments possessing their affections and
confidence. It may well be doubted, whether a militia thus
circumstanced could ever be conquered by such a proportion of regular
troops. Those who are best acquainted with the last successful
resistance of this country against the British arms, will be most
inclined to deny the possibility of it.

Besides the advantage of being armed, which the
Americans possess over the people of almost every other nation, the
existence of subordinate governments, to which the people are
attached, and by which the militia officers are appointed, forms a
barrier against the enterprises of ambition, more insurmountable than
any which a simple government of any form can admit of.
Notwithstanding the military establishments in the several kingdoms of
Europe, which are carried as far as the public resources will bear,
the governments are afraid to trust the people with arms. And it is
not certain, that with this aid alone they would not be able to shake
off their yokes.

But were the people to possess the additional advantages
of local governments chosen by themselves, who could collect the
national will and direct the national force, and of officers appointed
out of the militia, by these governments, and attached both to them
and to the militia, it may be affirmed with the greatest assurance,
that the throne of every tyranny in Europe would be speedily
overturned in spite of the legions which surround it. Let us not
insult the free and gallant citizens of America with the suspicion,
that they would be less able to defend the rights of which they would
be in actual possession, than the debased subjects of arbitrary power
would be to rescue theirs from the hands of their oppressors.

This prefatory paragraph gives the reader no useful information;
essentially, Mr. Madison is asserting that his following content is
intuitively obvious. In the writing of the time, this tactic was
common.

>That the people and the States should, for a sufficient period of time,
>elect an uninterrupted succession of men ready to betray both; that
>the traitors should, throughout this period, uniformly and systematically
>pursue some fixed plan for the extension of the military establishment;
>that the governments and the people of the States should silently and

>until it should be prepared to burst on their own heads, must appear
>to every one more like the incoherent dreams of a delirious jealousy,
>or the misjudged exaggerations of a counterfeit zeal, than like the
>sober apprehensions of genuine patriotism.

In this somewhat long sentence, Mr. Madison postulates the idea that
it would take "an uninterrupted succession of men" to subvert the
constitutional protections. Basically, the author is arguing that he
believes this could not possibly happen and that anyone who believes
it could isn't a "genuine patriot" but, instead, is a person
manifesting "the incoherent dreams of a delirious jealousy, or the
misjudged exaggerations of a counterfeit zeal". Here, the reader
learns exactly how Mr. Madison perceives what he terms "the military
establishment"; in the next sentence, he will call it the "regular
army"; elsewhere, he disparagingly refers to a "standing army".

The timeline here (1788) is that what was known as the "Philadelphia
Mutiny" by regular soldiers mustering out of the army who marched on
the capitol demanding their back pay would have been in Mr. Madison's
recent memory; therein, Mr. Madison demanded that the governor of
Pennsylvania call out the state militia to put them down and the
governor did so. Herein, the author is arguing for the ratification
of the 1787 constitutional convention's product; the proposal and
discussion of any "bill of rights" is still several years in the
future. The constitutional document in effect at the time of this
writing was the Articles of Confederation, ratified in 1781; thus,
when Mr. Madison will later speak of a "militia", he refers to the
definition given in Article Six of this document which reads in part:
"[Every] State shall always keep up a well-regulated and disciplined
militia, sufficiently armed and accoutered, and shall provide and
constantly have ready for use, in public stores, a due number of filed
pieces and tents, and a proper quantity of arms, ammunition and camp
equipage."

One other important point that the contemporary reader should note is
that the Articles of Confederation were superseded and augmented by
the Constitution of 1787, but never repealed; therefore, the 1781
definition of a militia remains in effect because the Constitution of
1787 never redefined that term.

> Extravagant as the supposition is, let it however be
>made. Let a regular army, fully equal to the resources of the

>the State governments, with the people on their side, would be able to
>repel the danger.

Here, Mr. Madison is clearly writing that the source of the threat, as
he sees it, is a "regular army"; the "State governments" will control
the militia as defined under article six of the Document of
Confederation (1781).

>The highest number to which, according to the best
>computation, a standing army can be carried in any country, does not
>exceed one hundredth part of the whole number of souls; or one
>twenty-fifth part of the number able to bear arms.

"[According] to the best computation..." would be rendered today as:
"Studies have shown...". Well, studies have shown that any idea
introduced by the phrase: "Studies have shown..." should be ignored.
We do not know to whose "best computation" Mr. Madison refers...
whatever. An important point to note here is that this represents Mr.
Madison's the first recorded use of the term: "to bear arms" and it is
obviously used in a military context; further, the context is given
previously in the same sentence. "To bear arms" is and always has
been a military term!

>This proportion would not yield, in the United States, an army of more than
>twenty-five or thirty thousand men.

Yes, if Mr. Madison's 1:25 premise held, then thus would be the 1788
numbers; it's probably not an unreasonable number.

> To these would be opposed a militia amounting to near
>half a million of citizens with arms in their hands, officered by men
>chosen from among themselves, fighting for their common liberties, and
>united and conducted by governments possessing their affections and
>confidence.

This sentence is important because it represents Mr. Madison's first
use of the term: "a militia". Federalist #35 had been published in
the prior weeks. (Federalist #35 was renumbered to #29 when the
documents were compiled and bound.) In Fed. #35, Alexander Hamilton
used the term: "Well regulated militia" as it was defined in Article
Six of the Document of Confederation; Mr. Madison did not propose a
redefinition. The other important point is that this "militia" is
"united and conducted by [state] governments".

Soon, Mr. Madison would become *very* aware of his error of faith in
the militia when he would become the only sitting U.S. President to
command troops in the field as he tried to hold the bridge at
Bladensburg, MD and his vaunted militia panicked and ran, sight
unseen, before the advancing English army; James Madison, the fourth
president of the United States, was forced to run through the streets
of Washington DC with the "debased subjects of arbitrary power" right
behind him... the militia weren't defeated; they broke and ran before
the enemy even came into sight; they were utterly humiliated.

So much for the militia.

>It may well be doubted, whether a militia thus circumstanced could ever
>be conquered by such a proportion of regular troops.

Yeah, right! History will not be kind.

>Those who are best acquainted with the last successful
>resistance of this country against the British arms, will be most
>inclined to deny the possibility of it.

Yeah, right again!

> Besides the advantage of being armed, which the
>Americans possess over the people of almost every other nation, the

>attached, and by which the militia officers are appointed, forms a
>barrier against the enterprises of ambition, more insurmountable than
>any which a simple government of any form can admit of.
.
Since Mr. Madison would later write the second amendment, this is the
sentence most often cited by the apologists for guns; however, the
author obviously speaks of the militia; specifically: "the existence
of [state] governments, to which the people are attached, and by which
the militia officers are appointed..." Mr. Madison never uses the
idea of armed citizens outside of the explicit context of the state
militia.

>Notwithstanding the military establishments in the several kingdoms of
>Europe, which are carried as far as the public resources will bear,
>the governments are afraid to trust the people with arms. And it is
>not certain, that with this aid alone they would not be able to shake
>off their yokes.

Any time James Madison wrote disparagingly of a "kingdom of Europe",
he always meant England; that was the only country who could have
possibly landed a military force on the American continent and who,
twenty-six years later during his presidency, would do so with
devastating effect as they marched unopposed into Washington DC,
looted the White House, and burned the public buildings.

Here, the author's meaning is clear; the states control their
respective militias: "[state] governments [...] who could collect the
national will and direct the national force [...] officers appointed
out of the militia, by [the state] governments, and attached both to
them and to the militia..." The author does *not* mean an armed mob.

>Let us not insult the free and gallant citizens of America with the suspicion,
>that they would be less able to defend the rights of which they would
>be in actual possession, than the debased subjects of arbitrary power
>would be to rescue theirs from the hands of their oppressors.

Again, Mr. Madison speaks of England; both Madison and Jefferson were
much further aligned with France than with England; Alexander Hamilton
(the author of Federalist 29) leaned toward the English perspective
and never spoke of "the debased subjects of arbitrary power".

**********

Nations are like humans in that they rise, flourish, and,
subsequently, die. What usually happens when a democracy dies is that
the country becomes ready for a dictator... then, one shows up and is
hailed as a popular savior; in this case, a militia is most often used
against a people instead of for them. Contrary to popular myth,
demagogues do *not* try to control the guns; they go after the media
as purveyors of "fake news" first, taking control under the guise of
disseminating the truth.

****************

About two years later, Mr. Madison would write: "A well regulated
Militia, being necessary to the security of a free State..." and, for
some unfathomable reason, many argue that the writer didn't really
mean to say "A well regulated Militia..."; what he meant was a "well
functioning" militia; like a clock that keeps good time[?] Actually,
he meant exactly what he wrote. He meant the well regulated militia
as opposed to a standing army. This differentiation is thematic in
the writings of James Madison until his traumatic experience in 1814.
What the second amendment did was to codify local control of the
militia. After the US militia were thoroughly humiliated in the War
of 1812, the United States moved to a standing army and the second
amendment became an eighteenth century legislative artifact.

This prefatory paragraph gives the reader no useful information;
essentially, Mr. Madison is asserting that his following content is
intuitively obvious. In the writing of the time, this tactic was
common.

>That the people and the States should, for a sufficient period of time,
>elect an uninterrupted succession of men ready to betray both; that
>the traitors should, throughout this period, uniformly and systematically
>pursue some fixed plan for the extension of the military establishment;
>that the governments and the people of the States should silently and
>patiently behold the gathering storm, and continue to supply the materials,
>until it should be prepared to burst on their own heads, must appear
>to every one more like the incoherent dreams of a delirious jealousy,
>or the misjudged exaggerations of a counterfeit zeal, than like the
>sober apprehensions of genuine patriotism.

> Extravagant as the supposition is, let it however be
>made. Let a regular army, fully equal to the resources of the
>country, be formed; and let it be entirely at the devotion of the
>federal government; still it would not be going too far to say, that
>the State governments, with the people on their side, would be able to
>repel the danger.

> Besides the advantage of being armed, which the
>Americans possess over the people of almost every other nation, the
>existence of subordinate governments, to which the people are
>attached, and by which the militia officers are appointed, forms a
>barrier against the enterprises of ambition, more insurmountable than
>any which a simple government of any form can admit of.
.

Go with the actual words and their meanings. And have evidence-based
policy.

Those words terrify the NRA and their supporters.

At the time of the founding, and for many years after, there were laws
against what we now call open carry, and even laws against having loaded
guns in homes.

The nonsense we are told now is just insane.

Here is a pretty lengthy discussion of them:

http://ir.lawnet.fordham.edu/cgi/viewcontent.cgi?article=4021&context=flr

| A variety of laws regulating firearms were already
| in place during the Founding Era. Militia
| regulations were the most common form of laws
| pertaining to firearms. Such laws could be quite
| intrusive, allowing government not only to keep
| track of who had firearms, but requiring them to
| report for a muster or face stiff penalties.
| Regulations governing the storage of gun powder
| were also common. States prohibited the use of
| firearms on certain occasions and in certain
| locations. A variety of race-based exclusions
| disarmed slaves, and in some cases, free blacks.
| Loyalty oaths also disarmed portions of the
| population during the Founding Era.
...
| Eighteenth-century statutes regulating the use of
| firearms can be classified as follows: statutes
| providing for the confiscation of firearms from
| persons unwilling to take an oath of allegiance to
| the state, statutes regulating the use of firearms
| within the context of militia obligations, and
| statutes regulating the storage of gunpowder. A
| smaller number of laws also regulated hunting and
| the discharge of firearms in certain places. These
| statutes make clear that regulation of firearms is
| hardly a modern invention.

This just asserts such laws existed, but without knowing the specific
legislation and more importantly when such legislation existed...

Then it really doesn't support your contention that the prohibition against
the federal government infringing upon such exercises was any less a
prohibition as it would be now. Because until the ratification of the 14th
Amendment, and the subsequent incorporation by SCOTUS, any Constitutional
provision for the protection of any right listed in the Constitution applied
only to the federal government.

As such you're going to have to show me that the federal government during
the 18th century and after the time of the BOR ratification imposed such
laws and they were accepted as allowed.

So unless you can show that such laws would fall, at the time, under the
preview of the US Constitution, then you might as well be talking about the
status of the laws in Japan since they would be just as irrelevant to the
issue.

The issue, IMO, is that our gun laws are set in Washington DC and they
should be regulated by the states. What is reasonable, "open carry",
for example, in rural Wyoming might not be appropriate in a major city
in New Jersey... and visa versa. The fed should be doing background
checks making sure nobody buys or sells across a state line; other
than that, they stay out of it.

The gun lobby won't like that because then they'd have to buy off 50
different state legislatures instead of one.

Somebody's been sipping Irish coffee.

I like your idea, though: we could disband ATF and give its budget and labs to the FBI, since it's
doing the NICS checks already.

You meant the anti-gun lobby, right? Those guys know they don't have a prayer in about 30 states.

2nd & 14th Amendments state otherwise.

Why not?

Does the person suddenly turn into a crazed killer if exposed to an urban
environment?

If so, then shouldn't we ban cities?

I don't see where guns cause harm.

People cause harm.

People misusing guns can cause harm.

However, when someone uses a gun to cause harm, it's not the gun causing the
harm, but the person using it.

So the PROPER question would be:

What is your suggestion to reduce the harm caused by violent people?

To which my response would be to do something about the violent people.

Specifically for repeat violent offenders:

Denial of parole, early release, or anything other than serving a full
sentence
Don't accept plea bargains
bring every charge possible
call for maximum sentence for each charge
require such sentences to be served consecutively rather than concurrently.

Then send them to jail for a very, very, very long time.

Odds are by the time they get out they will avoid any hint of violent crime
or they will be so old as to not be a real threat for engaging in violent
crime.

Without violent criminals engaging in repeat violent offenses, then rate of
violent crime will drop drastically.

Further once in jail we will be in a position to prevent them from getting
hold of any weapon far better than we can while they are out in society.

Now that's the short term solution.

The long term solution would be to identify and work to eliminate or
mitigate the circumstances which are most likely to result in people turning
to violent crime.

For if they don't turn to violent crime in the first place then they won't
be committing violent crime.

However, that's hard to do when a lot of stupid people try to blame an
inanimate object for the actions of some violent individual.

So you will not answer the question. You have NO ideas. Fair enough...
it is not an easy question.

But here are some things that will NOT work:

* Redefining the term "bear arms" to try to twist the law.

* Letting the NRA, a group that benefits from mass shootings, largely
control our gun laws.

* Working to STOP research to better understand the problem and possible
solutions.

Those are idiotic things... but we, as a country, do them.

What are you even responding to here? Just blabbering talking points
against straw men. Whatever. Not interested.

> So the PROPER question would be:

I asked the proper question. You avoided it. You have NO answer. As I
said, I think that is OK... it is not an easy problem to solve.

> What is your suggestion to reduce the harm caused by violent people?

That question has unsupported assumptions... ignoring the fact that
merely having a gun in the home, for example, has a stronger tie to
homicide than does domestic abuse or drug abuse (both of which have
pretty strong ties). Seems people who are not generally violent, when
they have a weapon that makes violence very easy, have a stronger
tendency to engage in violence than do people without such weapons.

In other words, this violence you speak of is not just about the person
but also the environment. When you ignore a component of this (which you
do here AND when you focused on just the gun, above) you are showing a
lack of understanding.

There might be some value to some of those things but we already have a
higher incarceration rate than, I think, ANY other country in the world.

What makes you think they would avoid "any hint of violent crime"?

You are focusing on crime only. Interesting movement of goal posts on
your part. Quite telling.

Blame an inanimate object? What?

Do you think it is blaming inanimate objects to improve the way cars and
roads are made?

It is clear you are not even willing to talk about the problem and
merely want to erect straw men to shoot down.

No, I am answering the question. Sorry, if the answer isn't what you wanted.

And yet, you do have ideas and they appear below.

So clearly your mouth is flapping in the wind even as your brain has no

Which is what you are attempting to do.

The NRA can't even introduce legislation and they certainly can't vote on
it.

Must really piss you off that so many people don't buy into your lies.

>
> * Working to STOP research to better understand the problem and possible

Not at all, but first you have to identify the cause, and that's not guns.

So while you're wasting time trying to understand how guns are the problem
and 'solutions' for the problem you don't understand.....nothing about the
real problem is done because you're trying to blame an object for what
someone does with it.

>
> Those are idiotic things... but we, as a country, do them.

No, as you said the NRA opposes such stupidity.

Now, come up with the actual cause (violent criminals) and a solution (lock
up violent criminals) then you will have a proposal for how to impose a
solution that actually addresses the cause and will do some good.

I have no answer to the question as asked because I don't blame an inanimate
object for the evil that someone does.

You clearly do. Then you wonder why your 'solutions' are opposed, and when
applied aren't effective.

>
>> What is your suggestion to reduce the harm caused by violent people?
>
> That question has unsupported assumptions...

And exactly what assumptions do you wish to claim are unsupported?

That you might have a suggestion?

That violent people cause harm?

That we need to reduce that harm?

Go ahead tell me what assumption is unsupported so I can resolve that issue.

>ignoring the fact that merely having a gun in the home, for example, has a
>stronger tie to homicide than does domestic abuse or drug abuse (both of
>which have pretty strong ties).

Actually illegal drug use is the highest correlation to homicide going.

But if you want to talk about correlations are you aware that the LARGEST
correlation ever discovered is having a dead bolt lock on your door?

Yep, if you hang a dead bolt lock then occurring to statistics you're
something like 29 times more likely to be murdered.

Who thought that locks were so dangerous. Maybe we should ban them?

Meanwhile, I note you ask me for information and I respond often citing
references and such to support what I say.

So far you have yet to produce ANYTHING to counter the cited facts I've
presented and you simply assert that I'm wrong, and you're right and that's
all that needs to be said.

Well, if you're going to advance your claims and show the world just how
much you actually know and how all the rest of us are wrong about the
language, meaning and intent of the 2nd Amendment, then you're going to have
to start producing some serious cited references that prove your claims are
totally and utterly true and that there is no other possible interpretation.

Until then, you're sounding more and more like a Rudy sock puppet.

You asked another, loaded, question and answered that.

Not the same as answering the question. Nor will you. But I shall give

What is your suggestion to reduce the harm tied to guns?

Nope. I use the term as it is used:

https://www.washingtonpost.com/opinions/antonin-scalia-was-wrong-about-the-meaning-of-bear-arms/2018/05/21/9243ac66-5d11-11e8-b2b8-08a538d9dbd6_story.html
-----
A search of Brigham Young University’s new online Corpus of Founding Era
American English, with more than 95,000 texts and 138 million words,
yields 281 instances of the phrase “bear arms.” BYU’s Corpus of Early
Modern English, with 40,000 texts and close to 1.3 billion words, shows
1,572 instances of the phrase. Subtracting about 350 duplicate matches,
that leaves about 1,500 separate occurrences of “bear arms” in the 17th
and 18th centuries, and only a handful don’t refer to war, soldiering or
organized, armed action. These databases confirm that the natural
meaning of “bear arms” in the framers’ day was military. But we
shouldn’t need big data to tell us this. “Bear arms” has never worked
comfortably with the language of personal self-defense, hunting or
target practice.
-----

Below you go off topic into crime and ONLY crime, how harsh we treat
criminals, blaming inanimate objects (WHAT?) and anything else you can
to move goal posts. Not biting.
