Yes, it binds *Apple*, *not* the customer.
And it's only relevant, *if* it's *higher* than the legal *lower*
limit. Guess what, it's not, because the legal ('consumentenrecht'
(consumer right)) lower limit is *two* years, as I've been saying a
zillion times.

I see that you've backpedaled on that one! Good! Yes, it is not
*necessarily* Apple, but it *can* be Apple if Apple is the seller (i.e.
Apple Store, etc.).

As said several times before, the *legal* 'consumentenrecht' warranty
(in *both* AU and EU) has *no* upper limit.
Also Apple (nor you) does not determine what is 'defective', the *law*
does. I.e. it does not have to be defective nor hardware. Anything
(hardware, software, documentation, services, service, etc.) which is
not up to reasonable expectation needs to be corrected under
'consumentenrecht'. (For example a paint job on a house has this kind of
warranty, even if nothing is specified and also if warranty is
explicitly excluded.)
I'm sure than neither Don nor Apple will even try to play the (non-)
warranty card, but Don *could* if he wanted to.
(AFAIC,) EOD.
