Going above the human limit is unfair unless there is an argument that not doing so is unfair. Being allowed to make any threat at any time is unfair because then a boxer can make a threat in the middle of a match causing the other boxer to take a dive. If a side has obtained an advantage from a threat not allowed, a reparation is fair. That reparation probably makes no sense as that the other side can make the same threat, because by then the boxing match might be ended.

The rest is less straightforward. I am not writing this of my own free will. This is my best guess. I would point out that the Blacks have obtained big advantages by making threats, perhaps as big as as if they did those things. Then the two can be considered equivalent. And it's not true that no one was hurt. And one can argue that since Blacks did the equivalent of that to others, it is fair to have it as an option if they lose a fair fight.
