Private gun sales are exempt by federal law.  You should keep a record of 
the transaction to protect yourself.

Nazi states like California require all firearm transfers to be processed 
by a licensed retailer which includes a background check and a record of 
the sale.

Does any of this prevent a mentally ill nut from misusing a gun?  No.  One 
of the first places law enforcement goes is to the last recorded owner of 
a gun used in a crime.  Does a crook care about records?  Not at all.
