But there is a guarantee that he should be able to use that ipad after the iOS update even if that requires that Apple provide a mechanism to return it to the previous version of iOS that it was running successfully, or resets the password on the Apple ID that is needed to allow the new iOS version to be used. That's the law. Apple gets to like that or lump it.

Wrong. The problem is with the iOS update that insisted that Don used the Apple ID that was originally used to setup the ipad after the update and Apple refuses to reset that password. > he forgot his password. he fucked up. Apple fucked up when they demanded the password that had been used to initially setup the ipad and had not requested that since then and refused to reset that password when they could trivially check that it was Don that has been using that ipad all this time and that it is still him using that ipad even now, so it can not be stolen.

Yes. It was a feature of the original release of iOS 9.3, but only affected older devices (e.g. iPad Air, iPhone 5S and earlier). Installing that release of iOS 9.3 may have required the device to be reactivated using the original Apple ID and password with which it was set up (possibly only if the device had been linked to the Find my iPhone feature). This was no problem for anyone who knew that Apple ID and password, but if you didn't, the device was stuck in a state where it couldn't be activated, unless you could reset the password for that Apple ID or (at least in some cases) remove the association of that device with Find my iPhone, or contacting Apple Support for help. This caused enough trouble that Apple pulled the original release of iOS 9.3 for the affected devices, and re-issued it a few days later, with the reactivation requirement removed. > I updated my iPhone from 8.x to 9.3.1 yesterday, and it only needed my > password if I wanted to log into iCloud. It was only a problem for people with older devices who installed iOS 9.3 within about three days of its original release. After that, the faulty version was not available, and the fixed version was released by the following week. -- David Empson dempson@actrix.gen.nz

That's a lie too. The seller supplied a second invoice with the serial number printed on it and Apple can trivially check with them that it is a genuine invoice and that it is not a fake produced by Don. And Apple has other ways to check that the ipad has been used by Don all this time, like checking the ip address its been used from and noticing that the original Apple ID that was used to setup the ipad initially contains his company name. So it isnt a stolen ipad. And as been said repeatedly here, they can get him to take it to an Apple Store, have the store unlock it and check what is on that ipad and that Don can tell them what is on it to prove that it isnt a stolen ipad too.
