Sigh! Please *read*. You grant Facebook a *"license to use"*, note
*"use"*, not *copy*.
It's the same thing as a software license, you can *use* it, but not
copy* it.
Especially note the last sentence: How could the license "end" if it
was OK to *copy* it (outside Facebook) *before that time?
Not also that it says "shared", which is sharing *within* Facebook.

What Facebook says or doesn't say on this issue is essentially irrelevant, because Australian (and international) 'copyright' law says that re-publishing without permission is an infringement [1]. FYI, (others and) I have had a site taken down for a similar issue. The offender was quite convinced that we didn't have a case. Guess what, he was wrong! As said in my other response, EOD, because the issue is moot. [1] IIRC, Grumpy posted a part of Facebook's T&Cs which actually *does* specifically describe this scenario and (permission) requirement. As I've mentioned a number of times now, there is a specific clause for anything posted to Facebook that *is* marked as "public" which allows it to be "accessed and used" by anyone, and you agree to this specific clause when you open your account. But it's a two way street. Facebook recognises that not everyone wants everything they post to be made publicly available which is why they provide the option to mark things as "private*". In such cases, people (or organisations) who want to access your information that is *not* marked as "Public" need to obtain your permission to do so which is why we have the specific permission clause you mention here, and if the two separate clauses did not apply to different circumstances they could contradict each other. In this "Grumpy versus Felix" war, there really are only two possible scenarios as to how Felix came to have Grumpy's pictures. The first is where they were found on Grumpy's Facebook page where they were marked as "public", which would have allowed Felix, who I don't believe to be a Facebook friend of Grumpy's, to "see" them and thus publish them elsewhere, and the second would be where Grumpy's pictures were all marked as anything *but* public and Felix managed to find some unknown "back door" into Facebook that bypassed the regular security settings and allowed him to see and grab photos that he wouldn't otherwise have access to when proper procedure was followed. If the first scenario is what actually happened then Felix broke no laws, as Facebook specifically permits such activity. However if the second was the case, then Felix broke every law under the sun and would be wide open for prosecution. However, I don't believe Felix to be a terribly smart man, and on the balance of probabilities I would think such activity as outlined in scenario 2 would make it highly unlikely that he broke any laws :) I think Grumpy's main problem in all of this is that he's somewhat embarrassed that he "left the gate open" so to speak, and didn't have his security settings as tight as they could be. Here he was boasting about his ability in IT, getting his time charged out at $3,000 per hour, etc. etc. yet he makes two of the most fundamental mistakes in IT security. One is the check out ALL security options (yes, he missed an obvious one!) and two is to double and triple check settings *from the outside*. Facebook even provides an option for that *outside check* though I always do it manually as well. Grumpy's reputation has been trashed and the funny part is, he did it all by himself.
