VANCOUVER, Wash — Marc Fogle, 54, of Clackamas, Ore., died from "multiple stab wounds of torso," according to the Clark County Medical Examiner's Office, which ruled the death a homicide. The incident began when deputies responded to a crash near Northeast 14th Court and Northeast Minnehaha Street in Vancouver at approximately 10:58 p.m. on May 7, the Clark County Sheriff's Office said in a press release. "Deputies believed that the driver was possibly impaired and conducted a DUI investigation," the sheriff's office stated. Fogle was arrested and taken to the Washington State Patrol Scale House in Ridgefield for a breath alcohol test, arriving at approximately 11:33 p.m. "The Sheriff's Office does not have its own machine for the breath test," the agency explained in a statement, noting that the scale house facility is "a common location for the breath test, especially for our Westside patrol units." At approximately 11:58 p.m., Deputy Bryson Layton reported over his radio that he was "actively in a physical altercation" with Fogle, according to the sheriff's office. During the altercation, the deputy reported that Fogle "attempted to take his firearm," and Layton then "stabbed the suspect several times," the sheriff's office said. Despite emergency aid attempts by deputies and response from a Clark- Cowlitz Fire Rescue ambulance, Fogle was pronounced dead at 12:39 a.m. on May 8. Layton, who has been with the sheriff's office since May 2023 and works patrol assignments, was not physically injured in the incident, according to officials. He has been placed on critical incident leave, per standard protocol. The Washington State Office of Independent Investigations (OII), created in 2021 to conduct independent investigations of deadly force by law enforcement, is handling the investigation. "We were notified shortly after this incident occurred and immediately dispatched our investigators to the scene," said Hector Castro, director of communications for OII, in an interview with KGW. Castro noted that OII investigators were already responding to another use of deadly force incident in Kitsap County when they received notification about the Clark County case. "Our first investigators arrived at about 4 a.m.," Castro said. "A little over half a dozen of our team members are on scene." The Washington State Patrol Crime Scene Response Team assisted with evidence collection and crime scene mapping. Investigators remained at the scene until 12:25 p.m. on May 8. According to OII, body-worn camera and in-car camera footage will be reviewed and released at a later date. The agency has established a tip line at 564-250-6275 for anyone with information about the incident. By statute, OII is required to complete its investigation within 120 days, Castro said. When finished, the case will be forwarded to the Clark County Prosecutor's Office for review.
