Splitting hairs.  The unlawful presence refers to previously 
authorized entrants who overstay.

Illegal aliens are law-breaking invading criminals and they should 
be treated as such - shot and dumped in mass graves.  Anyone who 
objects, shoot them and throw them in the same hole.
