Exactly the same issue occurs with copyright ("look and feel" litigation)
and "ever-green" patenting (pharmaceuticals).

The rot began when courts and patent offices began accepting any old
rubbish as innovation.

Just as nothing changed after the GFC, nothing will change in respect
of these.  It requires a complete social meltdown to occur before
governments make changes of any substance - and then only grudgingly.
